Stall Holder Terms & Conditions

When: The Cygnet Garden Markets take place twice a year (Autumn and Spring) on a weekend at the Cygnet Town Hall and surrounding areas on Mary Street, Cygnet and behind the Town Hall. Specific market dates are listed in the application form.  

 

Stall Size: All inside and outside stall sizes are 3x3m.

 

Market Theme: Cygnet Garden Markets are garden themed. They are held in Autumn and Spring. We encourage stall holders to embrace the season. This can be reflected in the decor and styling of the market stalls. 

 

Hours: The market runs from 10am until 2pm.

 

Bump in: Bump in commences at 8am ready for trade at 9.45am. We will notify you via email of the precise bump in schedule and details and stall number if your application is successful. Bring a trolley if you require one as they are not provided. Put the number of your stall on your dashboard so that if volunteers are helping you they know where to take your items. When you arrive there will be volunteers in high vis vests to direct you to your stall site. Unload your vehicle quickly so that you can then re-park your car to make way for other stall holders.

 

Parking: When you’ve unloaded, please park your car as far away from the Cygnet Town Hall as you can manage so that there are plenty of spaces for the the public (it’s a very popular market). There is no allocated car parking for stall holders on site. Suggested areas for parking are: Burtons Reserve, The Esplanade, George Street (behind St James), Lourdes Rise.

 

Market Cancellations: Where adverse weather means we need to pack up the market early or cancel entirely, no refunds or stall credits are given.

 

Other Regulations and Terms  

 

1. Stall allocations are made at the discretion of the organisers.  

 

2. Allocated stalls cannot be transferred, sublet or sold to any other person.

 

3. Products offered for sale must be as described and approved during the application process.  

 

4. If products are deemed inappropriate (eg: discriminatory or offensive) stall holders will be asked to leave.  

 

5. It is the responsibility of the stall holder to ensure they conform to any safety and compliance standards pertaining to their product.

 

6. We encourage each stall holder to supply their own current $10,000,000.00 Public Liability Insurance (PLI).  

 

7. The site fees must be paid by the due date.

 

8. Stall holders must be ready to trade at 9:45am and must continue trading until the market closing time of 2pm. Packing up of stalls should begin after 2pm. 

 

9. If you are unable to make your market booking, please inform the organisers.

 

10. Notification of non-attendance on actual market day should be made via SMS to 0402 129 865. 

 

12. Markets will operate in varying weather conditions and stall holders must be prepared for adverse weather.

 

13. At the discretion of the organisers, the market may close earlier if conditions deem this necessary. 

 

14. If the market is cancelled prior to the market day, stallholders will be notified via email as soon as the decision is made.

 

15. Organisers will not be held responsible for any loss including fees paid by stall holders, damage or injury whatsoever resulting from adverse weather conditions.  

 

16. Smoking is not permitted at any stall site.  

 

17. Stall holders are required to remove their own rubbish and waste from their immediate stall location. We aim to be a zero waste market (bring your reusable box/bag/plate/cup etc) and we provide FOGO bins at the event. Storage boxes & cartons must be removed from market area or hidden from public view during trading.

 

18. Stall holders are responsible for leaving their site and surrounding area clean, tidy and undamaged.  

 

19. Stall holders must provide their own table covers and stall display which must be in good working order and operated safely. Organisers do not provide any stall equipment, they only provide site area.  

 

20. All stall equipment including racks, tables, signage etc must be contained to the stall site boundaries. Public walkways must be clear at all times.  

 

21. Covers and all stall equipment must be erected securely and weighted or secured at all times regardless of the weather.  

 

22. Food vendors must comply with all relevant Local, State & Federal Health Regulations and Food Acts.

 

23. Stall holders must respond co-operatively to any direction of a security or safety nature given by organisers.  

 

24. Stall holders must ensure that their activities do not endanger the safety or security of any other stall holders or visitors at the market.  

 

25. Stall holders must report to management any incident or accident to any person or property that involves loss or could be expected to give rise to a claim.  Without limiting the generality of these terms, the stall holder acknowledges and agrees the organisers are not liable for any claim or loss suffered or incurred by the stall holder in relation to or in connection with:  

-Theft or damage of products, equipment or goods under the control of the stall holder or any other property of the stall holder at any time including times when the market is not trading.  

-Any failure by the stall holder to sell the approved products.

-Any journey from or to the market.

 

26. Food vendors must use compostable or reusable cups, plates and eating utensils for the customer use and have a current food licence. 

 

27. All power chords tagged and tested in the last 12 months. 

 

28. Stall holders should be prepared to trade outside in all weathers if required.
